COVID-19 Government Relations Daily Summary

The following Daily Summary includes state updates on the Governor's announcement to move into phase 3 reopening, information from the Departments of Employment Security and Public Health, and an informational bulletin from the Department of Revenue.  Federal updates include information from Treasury on FAQs for local government on the Coronavirus Relief Fund and SBA guidance on PPP for lenders.

Governor Pritzker Announces State will Move to Phase 3 Reopening

Governor Pritzker has announced Illinois can move to phase 3 reopening of the Restore Illinois Plan on May 29th.  In the coming days, the Illinois Department of Public Health will issue formal industry guidance, particularly around workplaces and childcare, for business owners and employers. Withdrawal of Enforcement Emergency Rules

The Illinois Department of Public Health withdrew Emergency Administrative Rules that were recently filed that provided for enforcement mechanisms of adherence to stay-at-home Executive Orders and non-essential businesses.  The Administration announced that it would work with State Senator Bill Cunningham and introduce legislation that will provide clarity to enforcement authority.

Illinois Withholding Requirements/Out-of-State Employers

The Illinois Department of Revenue issued Informational Bulletin 2020-29 for out-of-state employers and their employees who normally work in an out-of-state location but who will have performed normal work duties for more than 30 days in Illinois.  Out-of-state employers of Illinois residents may be subject to state withholding requirements if their employees work remotely in the state for more than 30 days due to the COVID-19 pandemic.

While much focus has been given on responding to employees impacted by COVID-19, IDES has posted information for employers to use when an employee who is collecting unemployment insurance refuses to return to work.  See form.

The Treasury Department has released updated FAQs and Guidance for State, Territorial, Local and Tribal Governments on the Coronavirus Relief Fund.

Paycheck Protection Program Procedural Guidance
The SBA has issued Paycheck Protection Program Lender Processing Fee Payment and 1502 Reporting Process.  The Procedural Notice provides lenders guidance on reporting PPP loans and collection and processing fees on fully disbursed loans which they are eligible to receive.  The guidance also provides claw back provisions which may conflict with earlier SBA guidance.  It is our observation that the claw back provisions would also apply to a CPA Agent.  ICPAS will seek clarification of the SBA Guidance.
