ILLINOIS EQUAL PAY REGISTRATION CERTIFICATION REQUIREMENTS

SUMMARY:  Illinois private employers employing over 100 employees are subject to equal pay registration certificate requirements and shall apply for and obtain an equal pay registration certificate between March 24, 2022, and March 23, 2024, from the Illinois Department of Labor.
BACKGROUND:  The Illinois Department of Labor has begun notifying employers with 100 or more employees of the new reporting requirements of Equal Pay Certification.  IDOL has staggered formal notification to businesses in Illinois that are subject to the reporting to accommodate due date reporting. IDOL will be sending additional notices over the next year and a half to manage the workflow and trainings. 
ICPAS Government Relations has previously provided information in Capitol Insight on employer registration requirements.  Because of the impact that these new reporting requirements may have on your firm and clients, we are providing this Regulatory Update and information from the Illinois Department of Labor.
Employers with fewer than 100 employees will be required to certify that they are exempt from specified provisions.
The specimen message below from IDOL to SELECT employers has been edited for brevity.  At this time, IDOL has not adopted Agency Administrative Rules to administer the amended provisions of the Act.



IDOL SPECIMEN MESSAGE TO SELECT EMPLOYERS

 
Pursuant to Public Act 101-656 and Public Act 102-36, businesses with 100 or more employees are required to register with the Illinois Department of Labor and obtain an Equal Pay Certificate from our Department.  Here you will find a template form (click this link and scroll to the bottom) with fields of data that your business will need to fill out when you are registering, in addition to the EEO-1 form that you file with the federal Equal Employment Opportunity Commission. 
In order to assist you in this new requirement, the Department will have four scheduled training sessions via webinar (you will only need to attend one, we just provide four sessions to help accommodate everyone’s schedule).  We will show you what the process will look like and answer any questions.  Below are the dates of the training sessions and the link to sign-up for the session.

Again, we ask for your patience as we implement this new law. This registration requirement only applies to private businesses with 100 or more employees.  It does not apply to public employers.
